1. Agreement to Terms

By accessing or using Thinxdone ("Service"), operated by AppSpark GmbH ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

5. Payment and Billing

5.1 Subscription Fees

Some aspects of the Service are provided on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly or annual basis.

5.2 Free Trial

We may offer a free trial to new users. You may be required to enter billing information to sign up for the free trial. You will not be charged until the free trial expires.

5.3 Refunds

All payments are non-refundable, except as required by law or as explicitly stated in these Terms.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

You may cancel your account at any time through your account settings or by contacting support.

IN NO EVENT SHALL APPSPARK GMBH, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to defend, indemnify, and hold harmless AppSpark GmbH from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts of Austria.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
